Terms of Service

These Terms of Service ("Terms") govern your access to and use of DraftYourApp (the "Service"). By creating an account or using the Service you agree to be bound by these Terms.
1. Eligibility
You must be at least 16 years old and able to enter into a binding agreement to use the Service. If you are using the Service on behalf of an organisation, you represent that you are authorised to bind that organisation to these Terms.
2. Account and security
You sign in via Google OAuth. You are responsible for keeping your Google account secure and for all activity that occurs in your DraftYourApp workspace. Notify us promptly at support@draftyourapp.com if you suspect unauthorised access.
3. Plans, billing and trials
The Service offers free and paid plans. Paid plans are billed in advance on a recurring basis via Stripe. New accounts may include a time-limited trial; at the end of the trial your workspace will downgrade to Free unless you upgrade. Subscriptions renew automatically until cancelled.
You can cancel a subscription at any time from Settings. Access to paid features continues until the end of the current billing period. Except where required by law, fees are non-refundable.
4. Acceptable use
You agree not to use the Service to:
- Build or deploy applications that violate any applicable law.
- Distribute malware, conduct phishing, spam or other abusive automated activities.
- Infringe the intellectual property or privacy of others.
- Generate sexually explicit content involving minors, or content that incites violence, hatred or self-harm.
- Probe, scan, overload or attempt to bypass our security mechanisms, rate limits or quotas.
- Resell the Service or sublicense access without our written consent.
We may suspend or terminate access if we determine, in good faith, that you have violated these rules.
5. Your content
You retain all rights to the apps, components and content you create with the Service ("Your Content"). You grant us a worldwide, non-exclusive licence to host, transmit, render and deploy Your Content solely to provide the Service to you.
You are solely responsible for Your Content and for any apps you deploy. We do not pre-screen content but we may remove or restrict it if it violates these Terms or applicable law.
6. AI features
The Service may use third-party AI providers (OpenAI, Anthropic) to generate code or content based on your prompts. Outputs are provided as-is and may be inaccurate, biased or incomplete. You are responsible for reviewing AI outputs before publishing them.
7. Service availability
We strive to keep the Service available 24/7 but do not guarantee uninterrupted access. We may perform maintenance, update or modify the Service at any time. We are not liable for downtime, data loss caused by third-party providers or force majeure events.
8. Disclaimers
The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Service will be error-free or secure.
9. Limitation of liability
To the maximum extent permitted by law, our aggregate liability under these Terms shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) one hundred US dollars (US$100). We shall not be liable for indirect, incidental, special, consequential or punitive damages, including loss of profits, data or goodwill.
10. Termination
You may delete your account at any time from Settings. We may terminate or suspend your access if you breach these Terms. On termination your right to use the Service ceases immediately and we will delete your data in accordance with our Privacy Policy.
11. Changes to these Terms
We may update these Terms from time to time. Material changes will be notified via email or via a prominent notice in the Service. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
12. Governing law
These Terms are governed by the laws of the jurisdiction where DraftYourApp is incorporated, without regard to its conflict of laws principles. Disputes shall be brought before the competent courts of that jurisdiction, unless mandatory consumer protection laws provide otherwise.
